Terms of Service
These Terms of Service govern access to and use of the MomoSense web dashboard, companion Android application, related APIs, and supporting services offered in Ghana. By creating an account, installing the companion app, or using the service, you agree to be bound by these terms.
1. Eligibility and Acceptance
You may use MomoSense only if you are at least 18 years old, legally capable of entering binding contracts, operating a business in Ghana or otherwise lawfully using the service in Ghana, and maintaining a valid Mobile Money account or account access that you are authorised to monitor.
If you use the service on behalf of a business or organisation, you represent that you have authority to bind that entity to these terms.
2. Service Description
MomoSense helps users monitor Mobile Money activity by reading eligible MoMo SMS notifications from a connected Android device, forwarding those messages to a cloud backend, and applying automated AI parsing to extract transaction information such as amount, transaction type, network, reference, and counterpart number.
Dashboard outputs are provided for operational visibility and record support only. MomoSense is not the source of financial truth for your business books, tax filings, audits, or reconciliations.
3. Account Registration and Security
- You must provide accurate, current, and complete registration details.
- You are responsible for maintaining the confidentiality of your login credentials and device API key.
- You must promptly notify dzotechsolution@gmail.com if you suspect unauthorised access to your account or connected device.
- You are responsible for all activity occurring under your account unless caused by our proven breach of security obligations.
4. Permitted Use
You may use MomoSense only for legitimate internal business tracking, reporting, and operational review.
You agree that you will:
- connect only MoMo accounts that you own or are expressly authorised to monitor;
- use the dashboard for lawful commercial record-keeping and workflow purposes;
- maintain a compatible Android device and internet access where required for syncing;
- review parsed results and correct any business records that rely on incomplete or inaccurate outputs.
5. Prohibited Use
You must not, and must not allow any third party to:
- monitor another person or entity's Mobile Money account without express lawful authority;
- use the service in connection with fraud, money laundering, deceptive trade, cybercrime, or unlawful surveillance;
- reverse engineer, decompile, interfere with, or attempt to gain unauthorised access to the platform;
- scrape, copy, resell, sublicense, or commercially exploit the service except as expressly permitted by us in writing;
- upload malicious code, overload the system, or circumvent plan limits, usage controls, or security protections.
6. Subscription Plans, Billing, and Credits
MomoSense currently offers the following monthly plans:
- Free: GHS 0, up to 5 transactions per month.
- Starter: GHS 19, up to 50 transactions per month.
- Growth: GHS 79, up to 500 transactions per month.
- Business: GHS 199, up to 2,000 transactions per month.
Paid subscriptions renew automatically each month through Paystack unless cancelled before the next renewal date. By subscribing, you authorise recurring charges in Ghana cedis for the selected plan.
Additional transaction credits may be purchased as top-ups: 100 credits for GHS 10, 500 credits for GHS 40, and 1,000 credits for GHS 70. Top-up credits are consumed only after the included monthly transaction allowance is exhausted.
Payments are non-refundable once processed, including subscription fees and credit top-ups, except where refund rights cannot be excluded under applicable law.
7. Availability and Operational Limits
We aim to provide reliable service, but uninterrupted availability is not guaranteed. Performance may be affected by mobile network delays, Android device permissions, SMS delivery timing, internet connectivity, third-party service outages, maintenance windows, or events outside our control.
We may suspend, throttle, or limit access where necessary to protect the platform, comply with law, prevent abuse, or carry out maintenance.
8. AI Accuracy Disclaimer
MomoSense uses AI-assisted parsing to interpret SMS content. AI outputs may be incomplete, inaccurate, duplicated, delayed, or incorrectly classified. You must independently verify important financial records before relying on them for tax, payroll, lending, legal, accounting, or regulatory purposes.
You acknowledge that the service is a business tracking aid and not a certified accounting system, bank statement, or authoritative settlement ledger.
9. Intellectual Property and User Data
We retain all rights, title, and interest in the software, interface design, models, documentation, trademarks, and other platform materials, excluding data you submit or generate through use of the service.
As between you and MomoSense, you retain ownership of your business data and transaction records. You grant us a limited, non-exclusive right to host, process, transmit, analyse, and display that data solely as necessary to provide, secure, improve, and support the service.
10. Suspension and Termination
You may stop using the service at any time. We may suspend or terminate your access immediately if you breach these terms, use the service unlawfully, create risk to other users, fail to pay applicable fees, or where continued access would expose us to legal or operational harm.
On termination, your right to use the service ends immediately. We may delete or anonymise data in accordance with our Privacy Policy and legal obligations.
11. Warranties Disclaimed
To the fullest extent permitted by Ghana law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.
12. Limitation of Liability
To the fullest extent permitted by law, MomoSense and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, customers, or business opportunity, arising out of or related to the service.
Our aggregate liability for all claims arising under or in connection with these terms will not exceed the total fees actually paid by you to MomoSense for the three-month period immediately preceding the event giving rise to the claim.
13. Governing Law and Dispute Resolution
These terms are governed by the laws of the Republic of Ghana, including the Electronic Transactions Act, 2008 (Act 772), the Data Protection Act, 2012 (Act 843), and other applicable Ghanaian statutes and regulations.
The parties will first attempt in good faith to resolve any dispute through written notice and direct negotiation. If unresolved, disputes will be submitted to the courts of competent jurisdiction in Ghana, unless the parties later agree in writing to mediation or arbitration.
14. Changes to These Terms
We may update these terms from time to time. If we make material changes, we will post the revised version on our website and may notify users by email or in-product notice. Continued use of MomoSense after the effective date of the updated terms constitutes acceptance of the revised terms.
